I’m a commercial agent and also the president of a brokerage. Can I use the title “president” in my advertising?
No. Even though you may hold such a title, using it in advertising implies you are responsible for the operations of the brokerage. Similarly, a sales agent cannot use the title CEO, COO, or other similar title in advertising. Remember, this extends to email or website addresses.
Follow up question: If the ‘commercial agent’ was a Broker…AND the designated Broker of his Real Estate firm…AND the President of that Real Estate Firm, could he use the title of President/Broker (or any variation of the two words) in his advertising?
I would say yes to your follow up question. The concern is to not represent that you are responsible for the brokerage activity unless you really are. As your question is phrased, you would in fact be responsible.
